{"id":64727,"date":"2026-06-05T17:34:43","date_gmt":"2026-06-05T14:34:43","guid":{"rendered":"https:\/\/sfuturem.org\/?p=64727"},"modified":"2026-06-05T17:37:35","modified_gmt":"2026-06-05T14:37:35","slug":"activists-affected-by-decree-66-arrested","status":"publish","type":"post","link":"https:\/\/sfuturem.org\/en\/2026\/06\/activists-affected-by-decree-66-arrested\/","title":{"rendered":"Activists affected by &#8220;Decree 66&#8221; arrested"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">The Syrian Future Movement is following with great concern the developments surrounding Legislative Decree No. 66 of 2012, which culminated in the recent arrest of Yasser Abbas, spokesperson for the &#8220;Association for the Repeal of Decree 66 and the Restoration of Rights,&#8221; and Engineer Ibrahim Sheikh al-Shabab, representative of the &#8220;Mezzeh Neighborhoods Committee for Monitoring Decree 66,&#8221; on Tuesday, June 2, 2026. The arrests were based on an official complaint filed by Damascus Governor Maher al-Idlibi, accusing them of &#8220;defamation and slander&#8221; via social media, stemming from their demands for justice and compensation for landowners in the &#8220;Marota City&#8221; and &#8220;Basilia City&#8221; projects. The following day, they were referred to the Eighth Criminal Court of First Instance in Damascus, which specializes in cybercrimes and communications.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong><em>The Syrian Future Movement recalls the full context of Decree 66 as one of the most heinous crimes of the ousted regime, reflecting its policy of forced displacement and the confiscation of public and private property:<\/em><\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The ousted president, Bashar al-Assad, issued this decree in 2012 under the pretext of &#8220;developing informal settlements and slum areas,&#8221; to create two development zones known as &#8220;Marota City&#8221; and &#8220;Basilia City&#8221; in the Mezzeh and Kfar Souseh districts of Damascus.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is worth noting that a 2018 report by Amnesty International warned that the new property law &#8220;punishes displaced people and could impede investigations into war crimes,&#8221; while Human Rights Watch described the decree as a tool used by the regime &#8220;to confiscate property and displace residents.&#8221; In June 2020, the US Treasury Department imposed sanctions on the former governor of Damascus, Adel al-Alabi, for his role in overseeing this project, describing it as &#8220;the largest real estate investment in Syria, worth millions of dollars, aimed at altering the demographics of the area.&#8221;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Syrian Future Movement points out that this arrest comes after a series of protests and popular rejection of the decree, which did not fall with the regime. On Wednesday, June 3, 2026, Damascus witnessed a protest in front of the Palace of Justice, in which dozens of those affected and human rights activists participated, demanding the release of those detained and the protection of citizens&#8217; right to express their demands related to real estate ownership.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Syrian Future Movement also expresses its astonishment at the use of a personal lawsuit by the governor of Damascus to prosecute peaceful activists by accusing them of &#8220;defamation,&#8221; especially since the association declared in its founding statement (May 18, 2025) its commitment to &#8220;continue the struggle until all usurped rights are restored and to reject any settlements that legitimize the outcomes of Decree 66.&#8221;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Syrian Future Movement reiterates its consistent positions, published on its official website, regarding the necessity of redressing the grievances of those affected and dismantling the legacy of the ousted regime. These positions include the study titled &#8220;Reconstruction Priorities in Syria&#8221; (dated December 19, 2024), which indicated that reconstruction cannot be complete without addressing the issues of real estate ownership and looted property as part of transitional justice.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>The Syrian Future Movement reviews the details of the Damascus Governorate statement issued on May 5, 2026, which was rejected by those affected as insufficient. The statement included some improvements, such as:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Increasing the floor share for original owners by 13.9% as compensation for the project&#8217;s delay.<\/li>\n\n\n\n<li>Raising the annual rental allowance budget from 1.6 billion to over 56 billion Syrian pounds (a 35-fold increase).<\/li>\n\n\n\n<li>Reinstating the right to alternative housing and compensation for more than 1,000 families who were previously deprived of it.<\/li>\n\n\n\n<li>The auction process was canceled, allowing owners to legally establish their ownership.<\/li>\n\n\n\n<li>Plans are underway to complete the infrastructure at a cost exceeding $250 million.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, the government simultaneously adhered to the legal legacy of the ousted regime, asserting that Decree 66 is a &#8220;regulatory decree, not an expropriation decree.&#8221; This means that ownership remains with the current owners as regulatory shares within the project. Those affected consider this a violation of the transitional government&#8217;s promises and of Presidential Decree No. 2 of 2025, which repealed Decree 66. The Marota and Basilia areas remain among the most contentious.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">While the Syrian Future Movement appreciates some of the Damascus Governorate&#8217;s steps to improve the situation of those affected, it believes that the Decree 66 issue is a true test of the Syrian government&#8217;s ability to implement transitional justice and address the legacy of injustice.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">We reiterate that the accumulated grievances of these citizens cannot be addressed by decisions that remain captive to the legal legacy of tyranny, nor can they be suppressed by legal complaints against those demanding their rights.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Based on its national responsibility, the Syrian Future Movement recommends the following:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>An immediate review of the legal proceedings against activists Yasser Abbas and Ibrahim Sheikh al-Shabab, and their release to uphold legitimate freedom of expression, especially given their health and social circumstances. The detainees are the father of a martyr and an elderly citizen suffering from chronic illnesses.<\/li>\n\n\n\n<li>The swift enactment of new legislation that definitively repeals Decree 66 and fully restores property rights to their owners with fair compensation, in accordance with the recommendations of the Syrian Transitional Justice Commission issued in May 2016, which called for settling outstanding property issues as a prelude to reconstruction.<\/li>\n\n\n\n<li>The formation of an independent and impartial national commission of inquiry, comprising representatives of the victims, human rights activists, and legal experts, to oversee the compensation and property restitution process and ensure transparency and community participation.<\/li>\n\n\n\n<li>The Syrian Future Movement calls for an end to the persecution of activists through personal &#8220;defamation&#8221; lawsuits. This approach is unbecoming of the &#8220;new Syria&#8221; and merely reproduces the worst practices of the ousted regime, which suppressed any dissenting voice under vague legal pretexts. The movement reiterates its absolute solidarity with all those affected by this unjust decree and affirms that their case is a priority for transitional justice and a true test of the sincerity of intentions in building a state of law.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">We urge the transitional government to resolve this issue definitively and completely, and to release all detainees.
