He was charged with human trafficking after filming a video in which he was seen beating his workers on camera, claiming it was &#8220;propaganda&#8221; and that they were &#8220;consent.&#8221;<\/p>\n\n\n\n<p>The study demonstrates that this incident is not an isolated case, but rather reflects a broader phenomenon in Syrian society. Estimates from the International Organization for Migration (IOM) in December 2014 indicated that 86% of respondents in its survey considered trafficking a problem in their communities, and 52% had experienced trafficking-related situations.<\/p>\n\n\n\n<p>The study is based on Legislative Decree No. 3 of 2010, which criminalizes human trafficking in Syria, and on recent international reports such as the 2015 US State Department report, which classified Syria in Tier 3, and the International Labour Organization&#8217;s report on forced labor, in addition to reports from the IOM and the Syrian Network for Human Rights.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-second-the-legal-framework-for-the-crime-of-human-trafficking\">Second, the legal framework for the crime of human trafficking:<\/h2>\n\n\n\n<p><strong>Definition of the crime in Syrian law:<\/strong><\/p>\n\n\n\n<p>Legislative Decree No. 3 of 2010 defines human trafficking as: \u201cThe recruitment, transportation, abduction, transfer, harboring, or receipt of persons for the purpose of exploiting them in illicit activities or for other unlawful purposes, in exchange for material or moral gain, or the promise thereof, or in pursuit of such gain.\u201d<\/p>\n\n\n\n<p>The crime is established by the presence of three interconnected elements: harboring, exploitation, and material benefit.<\/p>\n\n\n\n<p><strong>Elements and scope of the crime:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The material element: This includes preparatory acts (recruitment, transportation, abduction, transfer, harboring, and receipt).<\/li>\n\n\n\n<li>The moral element: The criminal intent represented by the desire to achieve material or moral gain.<\/li>\n\n\n\n<li>Means of Coercion: Article 4, Paragraph 2 of the decree stipulates that the crime is committed through the use of force, threats, violence, persuasion, exploitation of ignorance or weakness, fraud, deception, abuse of official position, collusion, or the provision of assistance by someone in a position of authority over the victim.<\/li>\n\n\n\n<li>Article 4, Paragraph 3 affirms that &#8220;in all cases, the victim&#8217;s consent is not valid,&#8221; thus negating any defense of coercion that the accused may raise.<\/li>\n<\/ul>\n\n\n\n<p><\/p>\n\n\n\n<p><strong>Penalties in Syrian Law:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Basic Penalty: Imprisonment from six months to two years and a fine of 100,000 to 200,000 Syrian pounds in cases of simple trafficking.<\/li>\n\n\n\n<li>Aggravated Penalty: Up to life imprisonment in cases of kidnapping or trafficking of children or minors.<\/li>\n\n\n\n<li>Additional Provisions: The decree stipulates the establishment of shelters for victims of human trafficking affiliated with the Ministry of Social Affairs and Labor, and the creation of a specialized department for combating human trafficking crimes within the Ministry of the Interior.<\/li>\n<\/ul>\n\n\n\n<p><\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-third-the-reality-of-the-crime-and-its-statistical-analysis\">Third, the reality of the crime and its statistical analysis:<\/h2>\n\n\n\n<p><strong>Syria\u2019s international classification:<\/strong><\/p>\n\n\n\n<p>The US State Department, in its 2025 report, classified Syria in Tier 3, the worst category. The report indicated that the Assad regime failed to meet the minimum standards for eliminating human trafficking and had not made significant efforts in this area.<\/p>\n\n\n\n<p>The report emphasized that the regime exploited its citizens through forced labor within the mandatory military service, holding them for indefinite periods under threat of detention and torture.<\/p>\n\n\n\n<p><strong>Statistics and field data:<\/strong><\/p>\n\n\n\n<p><strong>A rapid assessment conducted by the International Organization for Migration (IOM) in December 2024, in cooperation with the Protection Cluster in northwest Syria, revealed the following findings:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>86% of respondents believe that trafficking is a problem in their communities.<\/li>\n\n\n\n<li>52% have experienced trafficking-related situations.<\/li>\n\n\n\n<li>14% have been forced to work or placed in exploitative conditions.<\/li>\n\n\n\n<li>46% know someone from Syria who has been trafficked.<\/li>\n\n\n\n<li>24% of men were deceived into traveling or working under false promises.<\/li>\n<\/ul>\n\n\n\n<p><\/p>\n\n\n\n<p><strong>Prevalent forms of trafficking in Syria:<\/strong><\/p>\n\n\n\n<p>According to a report by the International Organization for Migration (IOM), the most common forms of trafficking in Syria are forced labor, sexual exploitation, and forced recruitment, in addition to trafficking-related practices such as child marriage, displacement, and domestic violence.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-fourth-an-analysis-of-the-abu-bassem-case-in-light-of-the-law\">Fourth, an analysis of the &#8220;Abu Bassem&#8221; case in light of the law:<\/h2>\n\n\n\n<p>The &#8220;Abu Bassem&#8221; case provides a clear example of the application of the Anti-Human Trafficking Law in Syria.<\/p>\n\n\n\n<p>The accused worked in commercial marketing and filmed a video showing him beating his employees on camera under the pretext of &#8220;advertising,&#8221; claiming they were &#8220;consent&#8221; on it.<\/p>\n\n\n\n<p>He was referred to the Criminal Investigation Department &#8211; Anti-Human Trafficking Unit, and charged with human trafficking based on Legislative Decree No. 3 of 2010.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<p><strong>The legal analysis of the case reveals that all elements of the crime are present:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The element of shelter: The accused provided accommodation for the workers.<\/li>\n\n\n\n<li>The element of exploitation: He exploited and beat workers in his business operations.<\/li>\n\n\n\n<li>The element of financial gain: He profited from their labor.<\/li>\n<\/ul>\n\n\n\n<p><\/p>\n\n\n\n<p>Article 4, Paragraph 3 of Legislative Decree No. 3 of 2010 affirms that the consent of victims (even if they declare themselves &#8220;satisfied&#8221;) is inadmissible under all circumstances, thus invalidating any defense the accused might raise on this point. The incident also establishes the well-established legal principle: &#8220;Ignorance of the law is no excuse,&#8221; as the accused claimed he was merely filming &#8220;publicity&#8221; without realizing his actions constituted a punishable offense.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-fifth-prevention-and-response-mechanisms\">Fifth, Prevention and Response Mechanisms:<\/h2>\n\n\n\n<p><strong>International Efforts:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The International Organization for Migration (IOM) conducted a training program in April and May 2025 targeting 80 participants (45 men and 35 women) in the governorates of Aleppo and Idlib, and in Gaziantep, Turkey, to enhance the capacity of humanitarian workers to identify and respond to trafficking risks.<\/li>\n\n\n\n<li>The Protection Cluster\u2019s monitoring dashboard showed an increase in the percentage of key informants reporting trafficking cases from 3% to 13%, reflecting improved staff awareness of trafficking indicators.<\/li>\n\n\n\n<li>In September 2025, the U.S. Department of State released its 25th annual Trafficking in Persons Report, which emphasized the need for countries to take serious action to combat labor exploitation and sex trafficking.<\/li>\n<\/ul>\n\n\n\n<p><\/p>\n\n\n\n<p><strong>Gaps and Challenges:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The 2025 U.S. Department of State report indicated that the previous regime had failed to achieve any criminal accountability for traffickers and had not identified or protected any trafficking victims.<\/li>\n\n\n\n<li>The International Organization for Migration (IOM) acknowledged the absence of comprehensive and specialized laws, policies, procedures, and programs to combat human trafficking in Syria, necessitating intensified efforts to protect the most vulnerable groups.<\/li>\n\n\n\n<li>The Syrian Network for Human Rights&#8217; 2025 annual report documented widespread violations, including the killing of four journalists and ten medical personnel, the perpetration of eleven massacres, and the deaths of two individuals under torture.<\/li>\n<\/ul>\n\n\n\n<p><\/p>\n\n\n\n<p><strong>Efforts of the Transitional Authority:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>In May 2025, the United States recognized the Syrian Interim Authority as the legitimate government of Syria. The Authority pledged to combat human and drug trafficking and to establish a transparent civilian security institution.<\/li>\n\n\n\n<li>In September 2025, the Interim Authority announced reforms within the Ministry of Interior, including strengthening efforts to combat human trafficking.<\/li>\n<\/ul>\n\n\n\n<p><\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-sixth-future-vision-and-recommendations\">Sixth, Future Vision and Recommendations:<\/h2>\n\n\n\n<p><strong>At the Legislative Level:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Enact a new anti-trafficking law that complies with international standards (Palermo Protocol) and criminalizes all forms of trafficking, including forced labor and child exploitation.<\/li>\n\n\n\n<li>Establish deterrent penalties commensurate with the severity of the crime, and increase penalties in cases of trafficking in children or persons with disabilities.<\/li>\n\n\n\n<li>Repeal any legal provisions that allow for the punishment of victims for actions committed as a result of being trafficked.<\/li>\n<\/ul>\n\n\n\n<p><\/p>\n\n\n\n<p><strong>At the Institutional Level:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Activate the role of the Anti-Trafficking in Persons Department within the Ministry of Interior and provide it with the necessary personnel and resources.<\/li>\n\n\n\n<li>Establish a national victim identification mechanism (NRM) and refer victims to appropriate services, including shelter, healthcare, psychological support, and legal assistance.<\/li>\n\n\n\n<li>Train judges, public prosecutors, and police officers on human trafficking cases and ensure that victims are not criminalized.<\/li>\n<\/ul>\n\n\n\n<p><\/p>\n\n\n\n<p><strong>At the Preventive and Awareness Level:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Launch community awareness campaigns on the dangers of human trafficking, workers&#8217; rights, and how to report suspected cases.<\/li>\n\n\n\n<li>Integrating human rights and anti-trafficking concepts into educational curricula.<\/li>\n\n\n\n<li>Cooperating with media outlets to cover trafficking issues responsibly and protect victims&#8217; privacy.<\/li>\n<\/ul>\n\n\n\n<p><\/p>\n\n\n\n<p><strong>At the regional and international levels:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Syria&#8217;s signing of the Protocol to Prevent, Suppress and Punish Trafficking in Persons, Especially Women and Children (Palermo Protocol), supplementing the United Nations Convention against Transnational Organized Crime.<\/li>\n\n\n\n<li>Strengthening cooperation with international organizations (UNODC, IOM, ILO) in the areas of capacity building, data collection, and providing assistance to victims.<\/li>\n\n\n\n<li>Integrating human trafficking issues into the national reconciliation and transitional justice agenda.<\/li>\n<\/ul>\n\n\n\n<p><\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-conclusion\">Conclusion:<\/h2>\n\n\n\n<p>Human trafficking is a flagrant violation of human dignity and fundamental rights. It is a crime that is not subject to any statute of limitations, and the victim&#8217;s consent is not valid.<\/p>\n\n\n\n<p>The case of Abu Bassem demonstrates that Syrian society still needs greater awareness of this crime and its various forms.
